Beta Terms of Service
These terms govern your participation in the Workout Titan Pre-Release Beta Programme. By installing or using any pre-release build, you agree to the conditions outlined below.
Workout Titan Limited is duly registered and incorporated under the laws of England and Wales. Our company is listed with Companies House under registration number 15657325. Registered with the ICO under registration number ZB796869. We, Workout Titan Limited ("us", "we", or "our"), operate the website found at https://www.workouttitan.com, the Basecamp coaching platform found at https://www.basecamp.workouttitan.com, and the mobile application available for download on the Apple App Store, for iOS and iPadOS, and on the Google Play Store, for Android, collectively referred to as the "Service".
These Terms & Conditions ("Terms") govern your participation in the Workout Titan Pre-Release Beta Programme ("Programme"). By installing or using any pre-release build ("Beta Software") provided via Apple TestFlight, Google Play Internal/Closed/Open Testing, direct APK distribution, or any other pre-release channel, you agree to these Terms. If you do not agree, you must not participate.
Introduction
These Terms should be read alongside our Terms of Service and Privacy Policy. Where these Beta Terms conflict with the general Terms of Service, these Beta Terms take precedence for matters relating to pre-release software.
Purpose of the Programme
The Workout Titan Pre-Release Beta Programme exists to give selected participants early access to features and builds before they reach general availability. The purpose is strictly developmental - your involvement helps us identify issues, gather feedback, and improve the product before public release.
Specifically, the Programme provides you with non-public, experimental software solely for:
- Evaluation of new features and functionality
- Providing structured feedback on usability, design, and performance
- Observing real-world performance across different devices and environments
- Identifying defects, compatibility issues, and user experience limitations
- Supporting controlled observation to inform product development decisions
Participation in the Programme is voluntary and does not entitle you to any compensation, ownership stake, or rights beyond those explicitly stated in these Terms.
Nature of the Beta Software - Important Risk Disclosure
The Beta Software is pre-release, experimental, and not representative of the final product. It has not undergone the same level of testing, quality assurance, or security review as our publicly released software. By choosing to participate, you acknowledge and accept that the Beta Software may behave unpredictably and that its use carries inherent risks.
Technical Risks
The Beta Software may exhibit a range of technical issues, including but not limited to:
- App crashes, hangs, and freezes
- Poor or unstable performance
- Device overheating
- Faster battery drain
- Unexpected data usage
- Corrupted data, including loss of saved workouts, logs, or settings
- Conflicts with other apps or system components
Security Risks
Because the Beta Software is still evolving and undergoing active development, its security posture may not meet the standards of our production releases. It may:
- Contain undiscovered security vulnerabilities
- Improperly handle data under certain circumstances
- Interact unexpectedly with device-level privacy settings
We take reasonable steps to protect your data during the beta process, but we cannot guarantee the same level of protection as our publicly released software.
Fitness & Well-being Risks
The Beta Software may produce inaccurate or incomplete outputs that could affect your training or well-being. Specifically, it may:
- Display incorrect metrics, such as calories, reps or progress tracking
- Provide inaccurate training suggestions
- Omit warm-up, cool-down, or safety reminders
- Estimate intensities incorrectly
- Over- or under-estimate physical exertion
- Misclassify workouts or exertion levels
- Provide incomplete or misleading guidance
You must not rely on the Beta Software for safety-critical or health-critical decisions. The Beta Software is a testing tool, not a substitute for professional advice or clinical-grade fitness technology.
Business Risk Protection (Liability Waiver)
To protect the continuity, financial integrity, and reputation of Workout Titan Limited, the following liability provisions apply to your participation in the Programme.
4.1 You participate in the Programme voluntarily and at your own risk. No one has required or coerced you to install or use the Beta Software.
4.2 Workout Titan Limited is not liable for any of the following, whether foreseeable or not:
- Lost fitness progress due to incorrect metrics
- Device malfunction or damage
- Lost data, including workouts or training logs
- Loss of business, income, productivity, opportunities, goodwill, or reputation
- Inaccurate health readings or analytics
- Reliance on erroneous fitness guidance
- Disruptions to phone performance
- Fitness outcomes, dissatisfaction, or missed training objectives
- Unexpected subscription charges or billing errors (if applicable)
4.3 To the extent permitted by law, and subject always to clause 4.5, you agree not to bring a claim against Workout Titan Limited arising from your participation in the Programme. Nothing in this clause affects your rights as a consumer, or any right that cannot lawfully be given up.
4.4 If you breach these Terms — in particular by disclosing confidential information or misusing the Beta Software — and a third party brings a claim against us as a result, you agree to cover the reasonable losses we incur from that claim. This applies only to claims caused by your breach, and nothing in it affects your rights as a consumer.
4.5 Nothing in these Terms limits liability where it would be unlawful to do so. This includes liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law.
Eligibility Requirements
Participation in the Programme is open only to individuals who meet all of the following criteria:
- You are 18 years of age or older
- You have a valid Apple ID or Google account
- You own a compatible device capable of running the Beta Software
- You are not prohibited from receiving pre-release software under the laws of your jurisdiction
- You agree to the confidentiality obligations set out in these Terms
- You will not share your TestFlight or Google Play beta access with any other individual
If at any point you no longer meet these requirements, your participation may be revoked without notice.
Mandatory Confidentiality & NDA Obligations
By participating in the Programme, you enter into a binding Non-Disclosure Agreement (NDA) with Workout Titan Limited. The confidentiality obligations outlined below apply from the moment you install the Beta Software and continue indefinitely, even after you leave the Programme.
What Counts as Confidential Information
All of the following are considered confidential and may not be shared, discussed, or disclosed outside the Programme:
- All pre-release builds, screenshots, and video recordings of the Beta Software
- Feature lists, UI layouts, UX flows, and design elements
- Roadmap details, internal documentation, or discussions shared with participants
- Analytics, results, KPIs, and performance metrics
- TestFlight or Play Store release notes
- Communications, surveys, or prototypes shared as part of the Programme
- All feedback submitted by you ("Feedback")
What You Must Not Do
As a participant bound by this NDA, you are strictly prohibited from:
- Sharing the Beta Software publicly or with non-participants
- Posting videos, screenshots, or descriptions of unreleased features on any platform
- Discussing the Beta Software's performance, issues, or metrics in any public forum
- Forwarding TestFlight or Play Store invite links to anyone
- Showing the Beta Software to individuals who are not enrolled in the Programme
- Publishing or distributing any confidential information by any means
- Analysing, reverse-engineering, decompiling, or tampering with the software, except to the extent the law gives you a right to do so that cannot be excluded
Ownership of Confidential Information and Feedback
All Confidential Information remains the exclusive property of Workout Titan Limited. Any Feedback you provide - including bug reports, feature suggestions, usability observations, and any other input - becomes our exclusive intellectual property once submitted. You waive any right to compensation, credit, or royalties in connection with Feedback you provide.
Duration of NDA Obligations
Your confidentiality obligations continue indefinitely or until the relevant information becomes publicly available through an authorised release by Workout Titan Limited. Leaving the Programme does not release you from your NDA commitments.
Participant Responsibilities
As a participant in the Programme, you are expected to engage constructively and responsibly. You agree to:
- Use the Beta Software in good faith and for its intended testing purposes
- Not rely on the Beta Software for essential training, medical, or professional use
- Ensure your device has recent backups before installing or updating the Beta Software
- Avoid using beta builds during critical training sessions where data accuracy is important
- Report issues, bugs, and feedback promptly and accurately through the designated channels
- Not attempt to exploit defects, vulnerabilities, or internal APIs discovered during testing
- Comply with Apple and Google's respective testing policies and guidelines
Reporting Issues, Bugs & Feedback
Your feedback is essential to the success of the Programme. We ask that all participants report issues clearly and constructively using the channels outlined below.
iOS (TestFlight)
If you are testing on iOS via Apple TestFlight, you can report issues through:
- Shake to Report - Shake your device while the app is open to trigger the built-in reporting tool
- "Send Beta Feedback" - Use the feedback option available within TestFlight
- Automatic crash log submission - Crash data is submitted automatically to help us diagnose issues
Android
If you are testing on Android, you can report issues through:
- Google Play "Send Feedback" - Available within the Google Play listing for the beta build
- Email channels - Contact details provided within the Beta build itself
- In-app feedback form - If implemented in the current build
What to Include in Your Reports
The more detail you can provide, the faster we can act on it. Helpful reports typically include:
- Your device model and operating system version
- The steps you took that led to the issue
- What you expected to happen versus what actually happened
- Screenshots or screen recordings, where possible (these remain confidential under NDA)
Exiting the Programme
You may leave the Programme at any time and for any reason. There is no minimum commitment period, and you will not be penalised for leaving.
Leaving the iOS TestFlight Programme
To stop receiving beta builds on iOS:
Open the TestFlight app on your device
Select Workout Titan from your list of beta apps
Tap "Stop Testing"
Delete the Beta Software from your device
Optionally, email us if you would like all telemetry data from your participation to be deleted
Once you stop testing, you will no longer receive beta updates. You may reinstall the public version of Workout Titan from the App Store if it is available.
Leaving the Android Beta
If you installed the Beta Software via Google Play:
Open the Google Play Store
Search for Workout Titan
Scroll to the "You're a Beta Tester" section
Tap "Leave"
Uninstall the Beta build from your device
Reinstall the public version if available
Optionally, email us if you would like all telemetry data from your participation to be deleted
If you installed the Beta Software via internal APK distribution, simply uninstall the app from your device. You will automatically be removed from the Programme.
Continuing NDA Obligations After Leaving
Leaving the Programme does not remove your NDA commitments. All Confidential Information you received during your participation must remain confidential indefinitely, regardless of whether you are still an active participant.
Data, Telemetry & Analytics Collection
During your participation in the Programme, the Beta Software may automatically collect certain data to help us monitor performance, identify issues, and improve the product. This data may include:
- Crash reports and error information, collected automatically by Apple TestFlight or Google Play
- Device model, operating system version and app build number
- Basic information about how the app performs, such as whether screens load and where errors occur
- Workout metadata such as durations, categories and intensity levels, which is part of your account rather than separate analytics
All data collected through the Programme is used solely for product development and performance improvement. We do not sell, share, or use this data for marketing purposes. For full details on how we handle your data, including your rights under UK GDPR, please refer to our Privacy Policy.
Intellectual Property
Everything in the Beta Software - including its code, design, features, branding, and documentation - remains the exclusive property of Workout Titan Limited. Your participation in the Programme grants you a limited licence to use the Beta Software, subject to the following conditions:
- The licence is limited to testing and feedback purposes only
- The licence is revocable at any time and without notice
- The licence is non-transferable - you may not share access with others
- The licence is strictly non-commercial - you may not use the Beta Software for any business or revenue-generating purpose
No rights, title, or interest in the Beta Software are transferred to you through your participation.
Termination
Workout Titan Limited may remove any participant from the Programme. Where it is practical to do so we will tell you first, though we may act immediately where the reason is serious — for example a breach of confidentiality, disclosure of unreleased features, or a security concern. Reasons for removal may include, but are not limited to:
- Prolonged inactivity or non-engagement with the Programme
- Breach of NDA or confidentiality obligations
- Misuse of the Beta Software or exploitation of discovered vulnerabilities
- Public disclosure of confidential information, features, or performance data
- Reverse-engineering, decompiling, or tampering with the software
- Harmful, disruptive, or abusive behaviour toward staff or other participants
- Security concerns arising from your device, account, or conduct
You may also terminate your participation voluntarily at any time by following the steps outlined in the "Exiting the Programme" section above.
Amendments
Workout Titan Limited reserves the right to amend these Terms at any time. If we make significant changes, we will notify participants where appropriate - for example, via email or through an in-app notice in the Beta Software. Your continued participation in the Programme after any changes are made constitutes your acceptance of the updated Terms.
Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with these Terms or your participation in the Programme will be handled exclusively by the courts of England and Wales.
